Korean severance pay is before tax: how the tax comes off
The figure from the Ministry calculator or your employer is before tax. Retirement income tax and local tax come off when you are paid. Here is the order, and what this calculator does.
Severance pay is quoted before tax
Article 8 of the Retirement Benefit Act says an employer pays at least 30 days of average wage for each year of continuous work. No tax has been taken from that figure.
When you are paid, retirement income tax (퇴직소득세) and local income tax come off. This tax is separate from the tax on your salary. Income Tax Act Article 14(6) makes retirement income its own tax base.
That is why the calculator figure and the money in your account differ. This calculator shows both.
Basic rules for pay and tax
Article 4(1) says employers need not provide severance for workers with under 1 year of service, or under 15 hours a week on a 4-week average. Part-time workers who meet both get the same rights.
Average wage is defined in Labor Standards Act Article 2(1)6: total pay in the 3 months before leaving, divided by the number of days in that period. If that is below your ordinary wage, the ordinary wage is used (Article 2(2)).
Retirement income tax follows Income Tax Act Articles 48 and 55. Take the service-years deduction off, divide by years of service, multiply by 12. That gives the converted pay.
Take the converted-pay deduction off to get the tax base. Apply the normal income tax rates, then divide by 12 and multiply by your years of service. This keeps savings built over many years from jumping into a high bracket at once.
Local income tax follows the same steps under Local Tax Act Article 92(4), at one tenth of the income tax rates.
Exactly what this calculator does
The leaving date is the day after your last working day. Days employed are the leaving date minus the start date. This matches the Ministry of Employment and Labor calculator.
The average wage period runs from the same date 3 months before the leaving date to your last working day. If that date does not exist in that month, February starts on March 1 and other months start on their last day. This also matches the Ministry calculator.
3/12 of bonuses and unused leave pay is added to the 3-month pay. The daily average wage keeps two decimals and rounds up at the third. Severance is daily wage × 30 × days employed ÷ 365, rounded to the won.
Years of service are counted on the calendar from start to leaving date, with any part year counted as a full year (Article 48(1)). Tax drops fractions of a won at each step.
What you enter stays in this browser. Nothing goes to a server. Your numbers carry over between pages.
Tips for entering numbers
For the 3-month pay, add the pay totals on your last three payslips. If the period starts mid-month, count only those days. The page shows the exact dates.
Only count bonuses from the last 12 months. Leave pay means money you got for unused annual leave.
Part-time? Enter your hourly wage, hours per day and days per week. If you do not know your 3-month pay, leave it blank to see the minimum from your ordinary wage.
If your employer already told you the severance amount, the tax calculator with that amount is more accurate.
What happens to the tax in an IRP
Retirement Benefit Act Article 9(2) says severance is paid by moving it into your IRP (individual retirement pension) account. Leaving at 55 or older, death, and foreign workers leaving Korea are among the exceptions.
Income Tax Act Article 146(2) says no tax is withheld on retirement income paid into a pension account, or put into one within 60 days. The tax is not cancelled. It waits until you take the money out.
Close the IRP and take a lump sum, and the deferred tax is withheld. Take it as a pension, and Article 129(1)5-3 sets the rate at 70% of the lump-sum rate for the first 10 years, then 60% up to year 20.
Which bank holds the IRP and how it is invested do not change this math. We do not recommend products.
Why your employer's figure differs
Most often it is the 3-month pay. Companies can treat meal money and some allowances differently.
Parental leave or approved sick leave inside the average wage period changes the result. Enter those dates and the pay you got for them in the left-out period fields on the severance page (Enforcement Decree of the Labor Standards Act, Article 2(1)).
Company rules that pay more than the law, or a DC pension plan, give a different amount. For the tax, enter the real amount in the tax calculator.
If you had an interim severance payment, enter the day after it as your start date. Service and pay restart from there.

What this calculation leaves out
Things we could not confirm from the source, or that this calculator does not work out.
- The cap on executive retirement income (Income Tax Act, Article 22(3)) is not applied. The excess is taxed as wages.
- With a defined contribution (DC) plan you get the account balance, so the before-tax amount differs. The tax is worked out the same way.
- The part-time check does not take out left-out periods. If you had one, use the severance calculator page and its left-out period fields.
- The withholding receipt may differ by a few won because of how the last digits are rounded.
- If your company rules pay more than the law, those rules apply. This shows the legal minimum.
- Non-resident taxation of retirement income is not covered. Resident rules only.
